SUBJECT: Nebraska Public Records Statutes Request – Medicaid ABA Prior Authorization & Disenrollment Metrics

To the Public Records Custodian:

Pursuant to Neb. Rev. Stat. § 84-712 et seq., I hereby request access to and electronic copies of the following aggregated, non-personally identifiable data fields maintained by the Nebraska Department of Health and Human Services (DHHS) Division of Medicaid and Long-Term Care:

1. The total number of unique Medicaid beneficiaries under the age of 21 with active prior authorizations for billing codes 97153 (Adaptive Behavior Treatment by Protocol) and 97155 (Adaptive Behavior Treatment by Professional) for each individual calendar month between August 1, 2025, and May 1, 2026.
2. Statistical data tracking the total number of prior authorization requests submitted for codes 97153 and 97155 that were partially denied, modified down, or fully denied by Heritage Health Managed Care Organizations (MCOs) due to the implementation of the 30-hour weekly service limit since its inception.
3. The total count of registered, active Medicaid-enrolled Registered Behavior Technicians (RBTs) and Board Certified Behavior Analysts (BCBAs) currently credentialed to bill Nebraska Medicaid as of May 1, 2026, compared to the corresponding historical counts maintained on July 1, 2025.

Please provide these records in an exportable electronic format (such as CSV or Excel spreadsheet). If any portion of this data is withheld or redacted under a statutory exemption, please provide a specific written citation detailing the legal basis for the omission as required by § 84-712.04.
